M/S PICKATRIP LLP is engaged in marketing and selling of domestic and international holidays, and other travel related services.
SCOPE OF ACTIVITY
We are travel and holiday organizers only. The role of the company is that of an agent of the client to secure proper services for the tour from the independent contractors and service providers such as the airlines, shipping company, hotels, Coach etc. We do not control or operate any airline, neither do we own or control any shipping company, coach or coach company, hotel, transport or any other facility or service mentioned in this brochure. We take care in selecting all the ingredients in your holiday; but because we only select them and have no control in operating them, we cannot be responsible for any injury, death, loss or damage, which is caused by the act or default or omission of the management or employees of any hoteliers, airlines, shipping company, coach owner / coach operator who are the company s independent contractors arising outside our normal selection process.
MAKING A BOOKING
Any booking made by you with us whether in written or oral is binding, and is subject to availability and is not confirmed. If the arrangements you wish to book are available we will issue a Confirmation Performa Invoice for the payment for a non – refundable booking deposit, after which we provide you with a detailed tour confirmation.
DEPOSITS & PAYMENTS
Upon receiving the tour confirmation, you must make payments as below –
- Earlier than 60 days:Non-Refundable booking deposit of USD 250 per person
- 60-45 days prior to commencement of tour: 50% of total price
- 45-30 days prior to commencement of tour: 75% of total price
- 30-00 days prior to commencement of tour: 100% of total price
THIRD PARTY PRODUCTS
In the event you are booking through us a tour / travel service of any third party operators like Traffelgar, Contiki, Insight Vacations, Cruise linersetc, the terms and conditions of such third party operators, including their payment schedule, cancellation, refundetc shall be applicable to you. In case of cancellation you will be liable for an additional non-refundable booking deposit of INR 5000 per person in case of any cancellation.
CUSTOM TRIP QUOTE DEPOSITS:
We provide tailor made quotes upon receipt of a non-refundable fee of INR 3500 per booking. This fee entitles you to a maximum of 2 iterations of your customized itinerary and costing. If you confirm a booking based on any of these iterations, the non-refundable fee of INR 3500 will be deducted from the final cost of the booking. The validity of the price will be indicated at the time of quoting. Additional iterations will be treated as new request. If the booking requests are not accepted by travelers with the time frame indicated in the quote will result in retaining the deposit towards administrative expenses by us.
THE PRICE OF YOUR HOLIDAY
The price of your travel arrangements are based on per person and quoted in currency specified and will be calculated using exchange rates prevailing on date of paymentrealization.
The price of your confirmed holiday is subject at all times to changes in transport costs such as fuel, scheduled airfares and any other airline cost changes which are part of our contracts with airlines (and their agents), cruise ship operators and any other transport provider; to cost changes arising from government like taxes or any other government imposed changes by the foreign country that you are travelling to; and to changes in currency exchange rates and to dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports any or all of which may result in a variation of your holiday price.
CHANGES BY YOU
If after your holiday has been confirmed, you wish to alter your booking, we will try to make the necessary arrangements provided we receive written confirmation before the date on which the final balance of the cost of your holiday is due. Changes and transfers will be subject to an administrative fee as well as any applicable rate changes or extra costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers. You should be aware that these costs could increase the closer to the departure date. Where we are unable to assist you and you do not wish to proceed with the original booking we will treat this as a cancellation by you. A cancellation fee will be applicable as mentioned herewith.
Note: Certain arrangements may not be amended after they have been confirmed and any alteration could incur a cancellation charge of up to 100% of that part of the arrangements.
CANCELATION BY YOU
If circumstances make you cancel the Tour, the cancellation must be intimated to us in writing. All cancellations will attract the following cancellation charges as mentioned
- Earlier than 45 days: Non-refundable deposit of US$ 250 per person
- 45-35 days prior to commencement of tour:50% of total price
- 35-21 days prior to commencement of tour: 75% of total price
- 21 days prior to commencement of tour: 100% of total price
Note: in addition to above certain arrangements cannot be refunded once they have been confirmed and could incur a cancellation charge of up to 100% of that part of the arrangements over and above mentioned above.
REFUNDS
Refunds (If any) would take at least 45 working days to process refunds.
There is no refunds payable for any unutilized or partially utilized services like air, hotel, meals etc.
Third Party refund i.e. airlines, cruise, overseas suppliers could take between 30 to 90 working days, provided relevant supporting are provided to the Company.
In case if a client along with his family is compelled to discontinue the tour due to any reason whatsoever including illness, death or loss of passport or any travel documents, no claim shall be entertained for refund of unutilized services.
Company shall in no circumstances whatsoever is liable to the client for:Any over stay expenses due to delay or changes in bus/ air/ trains / ship/ or cancellation of other services due to sickness, weather conditions, strike, war or any other cause whatsoever or any Loss/Damage of baggage by the Airlines/Hotels/Coach.
DEVIATIONS
If you wish to extend the travel before or likely to come back on a later date after the tour ends, there will be an additional charge (subject to availability of seats for the given dates and ticket validity). The additional charge will be advised to you on confirmation of the deviation date. The request for deviations should be given in writing to the company at the time of booking as these requests are
PRIVACY OF INFORMATION
We treat all the information furnished by you as confidential and will share only the necessary information with airline, hotels and other service providers who will provide the services to you during your tour. However we may be constrained to disclose the information furnished by you, if such disclosure is required by the law or by an order of a court or the rules, regulations or enquiry by any government / statutory agency having regulatory authority over the Company.
HOTEL
Hotels insist on photo-identification of the clients for security purposes. You would have to carry a valid photo identification document issued by the government (e.g. Passport, Driving License etc). In case of any issues with the services at the hotels, kindly inform the reception / duty manager immediately. In some cases, we reserve the right to provide alternate hotels of the same category based on the availability. Early check in and late checkout is always subject to availability at the hotel and can never be guaranteed under any circumstances. All baggage and personal effects are at all times and under all circumstances your responsibility. Some hotels offer the facility of safe deposit lockers, which can be availed of by you at your own cost and risk. Any damages caused to the hotel rooms / Coach / place of visit etc. during your stay/tour/visit, shall be borne and payable by you, and the company will not be liable for the same. Company is not liable if there is sudden disruption/disorder of telephone, internet services, and other amenities while staying at the hotels. The company will also be not responsible for the facilities provided or not provided in the room/bathroom/hotel premises etc. by the Hotel or its staff. Rude or Unprofessional behavior of hotel staff does not come under the direct purview of the company and the company will not be responsible for the same. Facilities like mini bar, pay television channels, telephone etc are not complimentary and these facilities if used by the client have to be paid for by the client directly to the Hotel and such charges are not included in the tour cost. The client will have to abide by the check in /check out time of the hotel. Any changes made directly by the hotel come under their direct purview and we will not be liable for any compensation due to this change.
AIRLINE:
The Company shall, in no circumstances whatsoever be liable to the client or any person traveling with him for Loss of Baggage by the Airline, Failure to provide meal of the clients choice by the Airline, Overbooking of seats by the Airline, Failure on the part of Airline to accommodate client despite having confirmed tickets, Meals offered by the airline/Quality of meal, Flight delay, if the client misses the flight, Changes of flight schedule/routing/airline mentioned at the time of booking. In this condition the expression howsoever cause includes willful negligence on the part of any person. If in the event that the client is booked on a particular Airline on a particular date and due to certain reasons beyond the control of the Company, the client is not allowed to board the flight, the client shall not hold the Company responsible for the same and no claim whatsoever can be made by the client against the Company. In case of any increase in Airport Taxes/Airport Development fees payable to the respective Airport shall be borne and payable by the Client. All the booking / cancellation / change of the airline ticket and the travel on such airline ticket will be subject to the terms and conditions of respective Airlines and the same may be provided to the client by the company upon request, if available.
MEALS
In case of any special dietary requirements, request is accepted only on request basis. During certain journeys and its nature there is limitation in to accommodate special requests and we bear no liability for the same.
HEALTH AND INSURANCE:
It shall be the duty of the Client to inform the Company in case the Client has any medical condition that may affect his ability to enjoy and pursue fully the Tour Arrangements and wherein the interest of the Group or any member thereof is prejudicially affected. Pace of certain tours might not be suitable to individuals. Hence we suggest that individuals may choose tours as per their health conditions. In the event that a medical condition has not been disclosed the Company will not be liable to provide any assistance or money back.
It is necessary, especially in case of International Holidays, for the client to obtain valid travel/health insurance prior to the commencement of the tour and the company will not be responsible for the same. Settlement of the claims will be entirely at the discretion of the insurance company to be filed by the client directly to insurance company.
JURISDISCTION
All dispute/complaints with respect to these terms and conditions and the tour and services shall be subject to the jurisdiction of Courts at Mumbai only. Upon confirming your holiday, these terms and conditions shall be binding on both the company and the client and shall become the only basis of relations between the parties and all previous communications in whatsoever form or mode, whether oral or otherwise, with respect to any terms.
